Summary, etc. En gran parte de América Latina el derecho financiero y bancario es una disciplina en gestación, de naturaleza híbrida y fuentes altamente dispersas. En Colombia los mayores impulsos a la formación de este derecho los ha dado la Superintendencia Bancaria, en especial con el Estatuto Orgánico del Sistema Financiero que a comienzos de los noventa lideró Néstor Humberto Martínez, autor de esta obra. La dispersión y la hibridez han impedido el desarrollo de un análisis doctrinario comprensivo en esta materia. Abunda la doctrina ad boc, llena de casuismos y elaborada con un marcado carácter intervencionista o jus publicista, sin que con ello se contribuya en manera alguna al riguroso entendimiento jurídico que debe gobernar la actividad financiera.
