| Summary, etc. | La interpretación jurídica, y especialmente la interpretación judicial de la ley, es una de las materias de mayor importancia en el ámbito del derecho.<br/>El autor analiza la evolución de la interpretación jurídica y los problemas fundamentales que se presentan cuando el supuesto de hecho de una norma debe enfrentarse a una situación concreta. Al analizar las disposiciones que regulan la interpretación legal en nuestro derecho descarta toda teoría exegética, señalando que es el sentido y no el tenor literal de la ley lo que debe considerarse para la determinación jurisdiccional del derecho. Su tesis modifica los conceptos tradicionalmente aceptados en nuestra interpretación legal y abre la posibilidad, a través de la labor interpretativa, de la adaptación del ordenamiento jurídico a la dinámica del progreso y de la evolución social. |
